Terms of Use

 

1. The Service

1.1 Arkipad are employed to produce drawings for use as part of any given planning application or building regulations application only, it is the client’s responsibility to submit any additional information to your local authority should it be required.

1.2 Unless otherwise agreed, the deliverable information for a typical Planning application will comprise of:

  • Existing Plans and Elevations at a scale of 1:100

  • Proposed Plans and Elevations at a scale of 1:100

  • Site location and Block plan at a scale of 1:1250 / 1:500

1.3 Unless otherwise agreed, the deliverable information for a typical Building Regulations application will comprise of:

  • Existing Plans and Elevations at a scale of 1:50

  • Proposed Plans, Elevations and Section at a scale of 1:50

  • Construction notes as required

  • Site location and Block plan at a scale of 1:1250 / 1:500

1.4 Unless otherwise agreed, minor amendments may be made to drawings following issue of draft drawings and prior to them being agreed as complete by the client. Major amendments such as the re-design of space, layout, appearance or material may incur an additional fee.

1.5 Unless otherwise agreed, minor amendments required by Officers representing Local Authorities will be made to drawings free of charge. Major amendments as listed under 1.4 may incur an additional fee.

1.6 Arkipad are not responsible for any building works carried out on site in relation to these drawings.

1.7 Arkipad will not cover any additional costs as a result of your application. These include but are not limited to the commission of additional reports, the hiring of additional consultants, the production and resubmission of drawings as requested or recommended by your Local Authority.

2. Fees and Payment

2.1 Paying a deposit of £49 is taken as your engagement of services offered by Arkipad. Payment of the deposit is acknowledgement that you, the client commits to paying the full fee as agreed at the time of paying your deposit.

2.2 Notwithstanding any staged payment agreement, the total fee (as agreed at the time of payment of the deposit) is payable once drawings are considered as complete. Drawings are considered as complete once the brief, supplied by the client upon payment of the deposit, has been fulfilled.  

2.3 Completed drawings will only be issued to the client once all outstanding fees has been received. 

3. Drawings

3.1 It is the clients, responsibility to ensure that they have established all of the planning requirements associated with their property and have made us aware of these prior to us starting work on your drawings. Amendments or alterations required as a result of the above may incur an additional fee. 

3.2 Our drawings are not a guarantee that of planning or building control approval. It is the customer’s responsibility to ensure all planning and regulatory requirements are met and local policies are adhered to.

3.3 Drawings are not to be used for construction purposes or any purpose other than applying for planning or building control approval.

3.4 All stated dimensions on drawings are to be verified on site.

4. Copyright

4.1 All drawings produced remain the intellectual property and copyright of Arkipad. Licence is given to use these drawings to secure planning or building control approval only. 

4.2 Licence is given to submit drawings once all outstanding fees have been paid and a final drawing set has been issued (drawings preceding final drawings will be labelled as ‘draft’).

4.3 You may not reproduce, replicate, reuse or alter drawings for any reason, in any way.

5. CDM (Construction, Design & Management) Regulations 2015 

5.1 Under the CDM regulations that came into effect April 2015, the client has legal responsibilities that require to be undertaken.

Your responsibility for a domestic project is automatically passed on to the contractor or principal contractor. 

You can transfer your responsibility to a designer / principal designer, however, this service is not to be provided in connection with this appointment. For your information, your project will become notifiable to the HSE under CDM 2015 if the construction work is scheduled to last longer than 30 working days and have more than 20 workers working simultaneously at any point in the project or if it exceeds 500 person days. 

CDM regulations require the client to forward all information regarding the existing building and site that are in your possession in addition to your project brief. This information would include any surveys, contamination and ground reports, structural drawings and previous planning and building regulation approvals if you have them. 

6. Other Consultants 

For any given project, where specialist consultants are required, each respective consultant will be under the direct appointment of the client. Arkipad inherit no responsibility for the work of external consultants, nor the effect of any given consultant’s impact on delay, budget and delivery of drawings.

7. Professional Indemnity Insurance 

7.1 Unless otherwise agreed, the amount of professional indemnity insurance to be maintained for any given project will be £750,000 in respect of each and every claim or series of claims arising out of the same originating cause. 

 

8. Liability 

8.1 Liability for loss or damage shall not exceed the amount of the professional indemnity insurance specified in 7.1 of these terms. 

8.2 No employee of Arkipad shall be personally liable to the client for any negligence, default or any other liability whatsoever arising from performances of the services provided. 

In respect to any claim by the client under the contract, and without prejudice to the provisions of clause 8.1, liability shall be limited to such sum as shall be agreed between the parties or adjudged by the court to be the proportion of the loss to the client caused by the designer’s failure to exercise reasonable skill, care and diligence in the performance of its duties under the contract. 

9. Disputes

9.1 We aim to provide a professional standard of service, but if at any time you are not satisfied, please bring the issue to our attention as soon as possible and we can discuss how to resolve the issue. We hope that we will be able to settle the matter by negotiation or mediation.

10. Acknowledgment

10.1 Payment of a deposit will be taken as your acceptance of the above terms.
